Co-Ownership of Real Estate

When there is more than one owner on a deed, the owners have co-ownership of the title. There are three categories of co-ownership:

  • Joint Tenants with Right of Survivorship: If one owner dies, the survivor remains the sole owner without probate.
  • Tenants by the Entirety: A marital form of ownership with survivorship rights between spouses.
  • Tenants in Common: Each owner holds a separate share without survivorship rights.

How to Do Power of Attorney?

In New York State, buyers and sellers must attend closings in person. If unavailable, they can appoint an agent via Power of Attorney.

  • The agent must be legally competent and sign on behalf of the principal.
  • Must comply with NYS legal forms and be notarized properly.
  • If signed overseas, notarization must be through a U.S. consulate.
